1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of the website doctorshnayder.com (the “Site”) and any services, memberships, and products offered through it (the “Services”), operated by Rafail Shnayder DO PA (the “Practice,” “we,” “us”). By accessing the Site, creating an account, or purchasing a Service, you agree to these Terms. If you do not agree, do not use the Site or Services.
2. Not Medical Advice; No Physician-Patient Relationship
Content on the Site is provided for general informational purposes only and is not medical advice. Viewing the Site or contacting us through it does not create a physician-patient relationship, which is formed only through an in-person or telehealth visit and, where applicable, a signed agreement. Do not disregard or delay seeking professional medical advice because of Site content. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.
3. Eligibility
You must be at least 18 years old to create an account or purchase Services. Services for minors must be arranged by a parent or legal guardian.
4. Accounts
Some features (such as the patient portal) require an account. You agree to provide accurate information, keep your login credentials confidential, and promptly notify us of any unauthorized use. You are responsible for activity under your account.
5. Services and Pricing
We offer, among others: Direct Primary Care membership, concierge membership, SmartCheck and functional/longevity programs, IV therapy, weight-loss programs, immigration examinations, and other services described on the Site. Prices are shown on the Site and may change; the price in effect at the time of your purchase applies. Certain clinical services require medical eligibility and provider approval and may not be appropriate for everyone.
6. Payments
Payments are processed by a third-party payment processor (Stripe). By submitting payment information, you authorize us and our processor to charge the applicable fees, and you represent that you are authorized to use the payment method. Full card details are handled by the processor under its own terms; we do not store them.
7. Direct Primary Care Membership
7.1 Separate Agreement. DPC membership is governed by a separate written Direct Primary Care Agreement between you and the Practice, as required by Florida Statutes § 624.27. These Terms supplement, and do not replace, that Agreement; if there is a conflict regarding membership, the signed DPC Agreement controls.
7.2 Fees. The current membership fee is $150 per month, plus a one-time enrollment fee of $80. Additional fees may apply for services not covered by the membership, as disclosed at the time of service.
7.3 Not Insurance. Membership is not health insurance. The following statutory statement applies:
“This agreement is not health insurance and the primary care provider will not file any claims against the patient’s health insurance policy or plan for reimbursement of any primary care services covered by the agreement. This agreement does not qualify as minimum essential coverage to satisfy the individual shared responsibility provision of the Patient Protection and Affordable Care Act, 26 U.S.C. s. 5000A. This agreement is not workers’ compensation insurance and does not replace an employer’s obligations under chapter 440.”
7.4 Automatic Renewal. Membership is month-to-month and automatically renews each month until cancelled. This automatic-renewal provision is disclosed clearly and conspicuously before you enroll, consistent with Florida Statutes § 501.165.
7.5 Cancellation. Either you or the Practice may terminate the membership by giving at least 30 days’ advance written notice, consistent with Florida Statutes § 624.27. The Practice may terminate immediately for breach of these Terms or the DPC Agreement, or for conduct that violates the physician-patient relationship. You may cancel by the same means you used to enroll and by contacting us at info@doctorshnayder.com.
8. Refund and Cancellation Policy
8.1 One-Time Services and Programs. If you purchase a one-time service or program (e.g., SmartCheck, IV therapy, an examination) and cancel at least 24 hours before your scheduled appointment, you may request a refund of amounts paid, less any non-refundable third-party costs already incurred on your behalf (e.g., laboratory fees). Cancellations made less than 24 hours in advance, and fees for services already rendered, are non-refundable, except as required by law.
8.2 Membership Fees. Except as stated in Section 8.3, monthly membership fees are non-refundable once the month has begun; upon cancellation, membership remains active through the end of the paid period, after which no further charges are made. The one-time enrollment fee is non-refundable.
8.3 Statutory Refund. Consistent with Florida Statutes § 624.27, if the Practice ceases to offer primary care services for any reason, we will refund membership fees paid in advance for services not yet provided.
8.4 How to Request a Refund. To request a refund, contact us at info@doctorshnayder.com with your name, date of purchase, and the service. Approved refunds are issued to the original payment method.
8.5 Chargebacks. If you believe a charge is in error, please contact us first so we can resolve it before initiating a chargeback.
9. Financing / Split-Pay
Where offered, financing or split-pay options may be provided by a third party under separate terms. The Practice is not the lender and is not responsible for third-party financing terms.
10. Third-Party Services and Links
The Site may link to or rely on third-party services (payment processor, scheduling, patient portal). Their terms and privacy practices govern your use of them; we are not responsible for third-party content or services.
11. Intellectual Property
The Site and its content (text, graphics, logos, images) are owned by the Practice or its licensors and are protected by applicable law. You may not copy, reproduce, distribute, or use the content except as permitted for your personal, non-commercial use.
12. Acceptable Use
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, submitting false information, or using it for any unlawful purpose.
13. Disclaimers
The Site and Services are provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free. This section does not affect the standard of care owed in the actual provision of medical services, and does not limit any right that cannot be excluded under applicable law.
14. Limitation of Liability
To the fullest extent permitted by law, the Practice will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for the provision of professional medical services.
15. Indemnification
You agree to indemnify and hold harmless the Practice from claims, damages, and expenses arising out of your misuse of the Site or your violation of these Terms, to the extent permitted by law.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.
17. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted, with the “Last Updated” date revised. Continued use after changes are posted means you accept them.
